1. THE CONTRACT

The contract for a short-term holiday rental will be between Atlantic View Holidays, (Mr. J.W.P. and Dr. S.E. Garthwaite, The Owner), referred to as “us” or “we’ and the person making the booking, (referred to as “you” or ‘your” in the following booking conditions). Sub-letting or selling the booking to anyone else is expressly forbidden. In the event of this happening no monies will be refunded, and the booking will not be allowed to go ahead. UK Law will govern the contract. The contract of hire is not effective until we have processed the deposit. The contract will be subject to these booking conditions, and must be complied with. The party leader must be at least 21 years of age at the time of booking and prior to arrival we must be provided with a list containing the names of all guests, the age of any under 18s and contact details (email address/telephone number) for all guests aged 16 or over.

Additionally you must inform us of the name of anyone who enters the house for any reason during your stay who has not previously been named, along with the date of their visit, in case of the need for Covid-19 contact tracing. If they scan the QR code on entering this will not be necessary. We encourage everyone in the houses to scan the QR code daily as the system re-sets at midnight. You may only receive legally allowed visitors and must adhere to current government Covid-19 guidelines for as long as they are place.

2. PAYMENT

Prices quoted include VAT at the prevailing rate. They are subject to periodic change. If there is a change to the rate of VAT after a booking is made we will honour the agreed price and will neither ask for a surcharge nor give a refund. The balance of rent due will be at the price agreed on booking.

The contract is not effective until a 25% deposit has been received from you and confirmation sent from us. Until then any booking made through our online booking system is provisional. The deposit must be paid within 7 days of booking being placed. Upon payment of the 25% booking deposit a binding contract for the booking is made between us and you. The balance of the rental will be due for payment 6 weeks prior to the holiday commencement date. The balance must be accompanied by the Damages Deposit of £400 per week or part thereof and a £100 Key Deposit. The latter is refundable as long as two sets of keys are left in the key safe on departure.

Bookings made within 6 weeks of the arrival date require payment in full at the time of booking.

3. REBOOKING

You will be offered re-booking of the same dates the following year, this offer being open for 4 weeks following departure. The exceptions to this are Christmas and New Year or if the owner opts to take the dates in question. There may be other exceptional circumstances in which this offer is withdrawn, however we will make every effort to accommodate return visitors.

4. CANCELLATION

Once the booking is made you are responsible for the total cost of the holiday and it may only be cancelled by writing to us preferably by email. If you cancel the booking more than 6 weeks from the start of the holiday you will lose the deposit. If you cancel the booking within 6 weeks of the start of the holiday the Damages Deposit will be returned but the balance will only be returned if the Owner is able to re-let the house. The deposit is non-refundable.

The Owners of Atlantic View House and Atlantic View Coach House have the legal right to reimbursement for loss due to cancellation.

The Owner undertakes to use all endeavour to re-let the house in the event of a late cancellation. Visitors are strongly advised to take out a suitable travel insurance policy to protect against cancellation. Any specialised holiday cancellation insurance is acceptable. Please take particular note of any exceptions when choosing your insurance.

The Owners reserve the right to refuse or terminate (without refund) any booking where we consider there to be a breach of our terms and conditions.

Should the Government place a closure notice on self-catering holiday accommodation we will contact each Visitor booked to discuss alternative dates (preferably) or, if mutually convenient dates are not available, a full refund will be issued.

While self-catering holiday accommodation is allowed to be open the Owner cannot be held responsible for cancellation or shortening of a holiday due to illness thought to be or proved to be due to coronavirus, either prior to or during a holiday. Whilst the Owner will make every effort to re-let the property there can be no guarantee that this will be possible, particularly at short notice. If the property is re-let the full cost of the holiday will be refunded (applies only to Covid-19 being reported prior to arrival, not during a holiday). All other illness related cancellations should be insurable and it is expected that insurance will be taken out. If it is not you must take responsibility for that risk and not expect compensation from the Owner should you fall ill.

If any of your party become unwell with symptoms thought to be due to coronavirus you must inform our caretaker immediately, pack up and your whole party return home to self-isolate in accordance with government guidelines. Under no circumstances can you assume that the properties can be used for self-isolation. If you are too unwell to travel and have to stay to self-isolate, you will be liable for the full cost of any subsequent booking(s) which have to be cancelled as a result.

5. CIRCUMSTANCES BEYOND THE CONTROL OF THE OWNER

If for any reasons beyond our control the accommodation is not available, we will either offer alternative dates or refund any monies paid, but will be under no further liability towards you. This includes the accommodation being unavailable due to Covid-19 infection in a previous guest.

6. PERIOD OF HIRE

Unless otherwise agreed with the owner occupancy starts on or after 6pm on the day of the start of the holiday and ends no later that 9.30am on the day of departure to allow our cleaning team time to prepare the houses for the next visitors. We have had to increase the time for the cleaning to accommodate the specific deep cleaning requirements of the current Covid-19 pandemic. In exceptional circumstances please contact us to discuss earlier arrival but otherwise the only exception is Sunday departure after a weekend only booking, when departure is 4pm. There can be no other exceptions to these revised check-in and check-out times. Please respect this rule as it is there for your safety. Any attempt to enter the houses or contact the cleaning team before they have completed their work will not be tolerated and may lead to immediate cancellation by the Owner without refund.

7. NUMBER OF PERSONS USING THE PROPERTIES

Atlantic View is let for a maximum of 14 people and Atlantic View Coach House for 8 people, plus a baby or babies in cots, except by prior agreement and subject to a surcharge to cover laundry and other costs. If the maximum number is exceeded without authority this constitutes a breach of contract and we may terminate the booking immediately. You will be liable for the full booking charge and the damages deposit will automatically be forfeited. At no time may parents or guardians leave children or teenagers in either Atlantic View or Atlantic View Coach House on their own overnight.

8. KEYS

The keys will be available in a key safe at each property, the code for which will be sent to you prior to arrival. You will receive two sets of keys. It is your responsibility to return the keys to the safe on departure, not the cleaner’s responsibility. The keys and the key safes will be sanitised prior to each new arrival. If you fail to return the keys a charge will be made against the key deposit for the emergency call-out of a locksmith, supply and fitting of new locks and all copy keys required. Please be aware that we also reserve the right to withhold your damages deposit because this issue must be taken with the utmost seriousness, due to significant cost and knock on effects.

9. LIABILITY

Supervision of babies, children and any adults requiring care remains your responsibility at all times.

We, the owners of Atlantic View House and Atlantic View Coach House, cannot accept any responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the properties and their plumbing, electrical supply or any other installation or for exceptional weather.

No responsibility is accepted for loss or damage to property, vehicles or vehicle contents belonging to you. If you leave any belongings at the properties we will endeavour to find and return them for a proportionate fee, but cannot guarantee to be able to do this.

If you want to engage a third-party supplier to provide services to your group, such as caterers, beauty therapists, babysitters etc, you MUST seek permission from us to do so. We would need written details for the service provider in order to obtain approval from our insurance company for the third-party supplier and ascertain that they have adequate Employers Liability insurance coverage and a current Public and Products Liability policy. A risk assessment would need to be carried out to obtain prior approval. NO liability is accepted for activities provided by a third-party supplier, even if we have suggested their services to you.

The property is for holiday use ONLY and you should not engage in anything dangerous at the property, which includes the area of clifftop immediately in front of the houses (but not the road) and extends to the sand at the base of the cliff.

Where we have made a recommendation or suggestion of a particular third party supplier, this is based on the genuine belief and experience of us or from feedback from other guests, and we shall not be liable for the failure of a particular service provider to properly perform the relevant services. This is a matter between you and the relevant third party service provider.

10. CARE OF THE PROPERTY AND BEHAVIOUR

While you are staying you are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings and effects, in or on the property. You must leave them in the same state of repair, and in a reasonably clean and tidy condition at the end of the rental period.

You must not use the properties for any dangerous, offensive, noxious, noisy, illegal or immoral activities or carry out there any act that may be a nuisance or annoyance to the owner or other neighbouring properties, including intrusive noise after 11pm. Smoking is not allowed in either of the properties both inside and outside, although the clifftop is acceptable as long as cigarette butts are disposed of in an outside bin. We ask for and expect reasonable and considerate behaviour from our visitors.

If, in our opinion, any person is not suitable to continue their occupation of the property because of unreasonable behaviour, damage or nuisance to other parties, the contract may be discharged and we may repossess the property immediately. You will remain liable for the whole cost of hire and no refund of either rent paid or the damages deposit shall be due.

11. CLEANING ON DEPARTURE

Please refer to our enhanced cleaning regime published on the website. Note that all persons carrying out cleaning will wear PPE and a signed record of the cleaning undertaken will be left in the property.

If you book a holiday lasting 10 days or more an interim clean will be arranged either for the middle Friday (2 week holiday) or at a time to suit. If you are staying for less than 10 days additional cleaning can be arranged by prior agreement at a mutually convenient time and subject to a surcharge to cover the cost. Please note that due to Covid-19 you will be asked to tidy up prior to any clean, strip your beds and empty the bins (see the next two paragraphs) and to vacate the property while the cleaning team are working in the property.

Not included in your rental: Stripping of beds on departure. Due to the Covid-19 pandemic we are following guidelines to supply a linen bag in each bedroom and visitors are now responsible for carefully stripping their beds of pillow cases, sheets and duvet covers without shaking them and placing them in the bags, along with all towels and bath mats, kitchen tea towels and oven gloves, tying the drawstrings and leaving the bags ready for collection by our cleaning team. Please do not remove mattress or pillow protectors, which will be sanitised using a special spray. However, if these clearly need to be laundered please add them to the linen bags.

Emptying of bins. Again, the Covid-19 guidance is being followed and visitors are expected to tie up the bin liners provided in each bin and to dispose of ALL rubbish (from the bins in each room including bathrooms and the kitchen bins) in the correct bulk waste bins outside. Please do not leave any unwanted items anywhere in the house; either dispose of it or take everything home. This includes unwanted food in the fridge, freezer or kitchen cupboards.

12. DAMAGES AND BREAKAGES

You are legally bound to pay for any damage or loss however caused, excluding reasonable wear and tear, incurred during the occupation. We recommend that you have insurance in place to cover this.

We retain the right to reasonable access to the property or our agents if deemed necessary. This will be kept to an absolute minimum during the Covid-19 crisis in order to deal with any immediately necessary caretaking or repair issues. We will ask tenants to vacate the property during any such visit.

If in our opinion any person is not suitable to continue their occupation of the property because of unreasonable behaviour, damage or nuisance to other parties, the contract may be discharged and we may repossess the property immediately. You will remain liable for the whole cost of hire and no refund of either rent paid or the Damages Deposit shall be due.

You agree to pay a damages deposit of £400 per week or part thereof, 6 weeks prior to arrival. This will be returned to you as soon as possible after departure following an inspection by the Caretaker and reading of the meters, providing that the house is left in good order with no damage other than fair wear and tear. Failure to remove sand from your feet or shoes prior to entering the properties and subsequent damage to the timber floor surfaces is specifically excluded from fair wear and tear. Any such damage will be charged for. We provide outside taps to rinse feet, absorbent door mats and facilities to rinse and hang wetsuits in the utility areas and you are required to use these.

The cost of any damage and of oil (Atlantic View only), water and electricity will be deducted from the damages deposit. If it is insufficient to cover these costs you must pay the shortfall within 7 days of notification. Any failure to do so may result in a Small Claims Court action.

13. WIFI

Wi-Fi is provided for guests’ reasonable use. The guest agrees to reasonable and lawful usage of this service.

14. DRONES, NIGHT LANTERNS AND FIREWORKS

The use of drones from the property is not allowed. Fireworks and Night Lanterns are expressly forbidden to be set off from any part of the property including the cliff in front of the house.

15. PETS

We only allow dogs by prior negotiation and written consent during the period 1st October to Good Friday, when the beach is open to dogs. There will be a charge of £25 per dog per stay and a maximum of two dogs per house. No other dogs are allowed inside the property. We reserve the right to charge for extra cleaning in addition should the £25 charge not cover these costs. Any agreement to accept dogs will be subject to a number of reasonable rules, which will be provided to anyone enquiring about bringing dogs.

We do not accept dogs between Good Friday and 30th September when they are not allowed on the beach.

We cannot provide assurances that the properties are suitable for anyone with a dog allergy.

No other pets will be allowed.

16. SMOKING

Smoking is not allowed in either of the properties or the whole of their grounds including the parking area, balconies, the patios and the lawn. We ask that you go outside the grounds to smoke (the clifftop is acceptable) and dispose of cigarette ends responsibly, in an outside bin.

17. DESCRIPTIONS

Whilst we makes every effort to ensure the accuracy of the property descriptions, they are inevitably subjective and are for guidance only. If there are any points of particular importance please contact us for clarification. Whilst we have taken all reasonable steps to ensure the information contained in brochures, websites, advertisements and any other promotional literature is accurate, we reserve the right to alter, substitute or withdraw any service, facilities or amenity.

18. COMPLAINTS

Every effort has been made to ensure that you have an enjoyable stay. However, if you have any problem or cause for complaint, it is essential that you contact us immediately to give us the chance to resolve it. We value your custom and want you to return.

ADDITIONAL NOTES

Included in your rental:

  • Self-catering accommodation
  • Sheets, pillowcases, duvet covers, bath towels, hand towels and bath mats
  • Kitchen starter pack consisting of drying-up cloths, oven glove, dishcloth, scourer, dishwasher tablets, whites washing tablets, colours washing tablets and washing up liquid
  • Welcome pack of mainly local produce usually including a bottle of fruit juice, tea, coffee, milk, sugar and biscuits.

Not included in your rental:

  • Beach towels – please bring your own and do not use the house towels provided anywhere outside the house. Alternatively you can hire beach towels. Details will be provided with the balance of rent receipt
  • Electricity, Water and Oil (Atlantic View House) or Electricity and Water (Atlantic View Coach House)

Electricity, water and oil are all metered. The meters are read at the beginning and the end of each let and the readings given to the Owner, who then calculates the exact amount due according to prices current at the time, with no administration fee or surcharge.
